Pre-Nuptial and Post-Nuptial Agreements

A pre-nuptial or post nuptial agreement can be useful uf you have any assets that you wish to protect in the event that your marriage is not successful.  It is a formal agreement that sets out how certain assets will be divided if the marriage breaks down.  A post-nuptial agreement is similar to the pre-nuptial agreement. The main difference is that the post nuptial agreement is made after the marriage ceremony.

These agreements are not legally binding in UK law. They can be used persuasively in cases where they are relied upon. If the court is satisfied that each party entered into the agreement fairly – without any coercion then it is likely that the court would uphold its validity.
